    In a high-stakes legal maneuver concerning digital trade secrets, Epic Games has reached a proposed settlement with a former contractor accused of leaking confidential information related to Fortnite.

    The dispute centers on the actions of a former worker who Epic alleges repeatedly misappropriated and publicly broadcasted trade secret information acquired while working on the project. The individual in question was identified as Hayden Cohen, who is also known by the online moniker AdiraFN.

    Epic initiated legal action in March against Cohen, asserting that despite signing a Non-Disclosure Agreement (NDA), he repeatedly shared sensitive partner IP and trade secrets through anonymous social media accounts on platforms like X (formerly Twitter) and Discord. The core accusation was that this breach of contract extended beyond a simple violation of an agreement into the realm of corporate espionage.

    In response to these allegations, Epic Games confirmed that they pursued legal action to protect their intellectual property. Natalie Munoz, the company’s director of corporate communications, stated that the firm sought a court order to ensure that former contractors could not again publish or share confidential information.

    The proposed settlement addresses this issue by seeking an injunction against Cohen, effectively barring him from possessing, accessing, using, or disclosing any of Epic’s confidential or trade secret information, and preventing him from assisting anyone else in doing so.

    Notably, the agreement focused exclusively on securing this injunction. Unlike initial demands that sought compensatory damages for actual loss or unjust enrichment, this settlement did not include a monetary penalty. This approach underscores the focus on protecting proprietary knowledge rather than financial recompense in this specific case.

    This legal move highlights the growing tension between creative collaboration and digital ownership in the gaming industry, emphasizing how crucial it is for companies to safeguard their valuable intellectual assets in the constantly evolving digital landscape.
