Thailand suspends 49 data center buildouts awaiting law
The global race for massive data center expansion is hitting a major roadblock. While the demand for AI and hyperscale computing continues to skyrocket, many cities and states have instituted moratoriums on new buildouts, citing serious concerns over power usage, water consumption, and noise pollution. Now, Thailand is leading the charge, putting the proverbial brakes on construction and demanding a more precise regulatory framework for the burgeoning data center industry.
The core issue stems from a legal vacuum. Thailand currently lacks specific laws governing data centers, leading to frustrating legal ambiguities, such as zoning a massive facility as a “warehouse” right next to a hospital. This absence of clear rules, coupled with growing public complaints about the environmental footprint of these operations, has prompted a governmental review.
In response, government bodies have requested that agencies compile comprehensive information about current and future data center developments, aiming to create unified national legislation. This process, while crucial, is proving to be a slow-moving endeavor, with the government expecting about a month to develop a regulatory draft. However, pausing construction is not strictly enforceable, allowing some developers to proceed while the legal framework is being debated.
Despite the pause, the industry is dynamic. Companies are opting to continue development, betting that they will either comply with the future laws or successfully challenge them. This approach mirrors ongoing legal battles in other jurisdictions where projects continue despite court injunctions, suggesting a willingness among builders to navigate the regulatory uncertainties.
The upcoming legislation is expected to address critical areas, focusing on power consumption (and generation), closed-loop cooling systems, and water-surplus guarantees. This means builders are already anticipating requirements for sustainable practices.
A significant part of the new framework centers on ensuring fair resource allocation. Thailand has revised its industrial power delivery laws, introducing a mechanism designed to prevent companies from preemptively securing power capacity they might not use. This system mandates a bank guarantee of ฿4.5 million ($134,000) per megawatt. This mechanism ensures that power delivery capacity is allocated only when actual usage occurs, mirroring industry best practices worldwide.
For hyperscale facilities that demand substantial power, such as those pulling 200 MW or more, this financial safeguard translates into a significant escrow requirement, around $27 million. This cost structure ensures that power infrastructure development aligns with real consumption, offering a powerful lever for sustainability and accountability.
Furthermore, concerns over water usage are intensifying. As the legal framework matures, expectations are that the new laws will impose much stricter requirements to prevent localized water scarcity, especially as operators secure long-term water deals with utilities. This shift signals a move toward guaranteeing water sufficiency, moving beyond simple usage permits to environmental responsibility in the high-demand data center sector.
