The agency recently approved the use of two new chemicals for semiconductor manufacturing, but critics argue that this process prioritized industrial convenience over public safety.
These substances, identified as photoacid generators, are essential for making advanced chips, yet they carry serious health implications. Lawsuits brought by non-profit organizations allege that exposure to these chemicals poses severe risks to human health, including potential “sudden death,” cancer, neurological damage, eye corrosion, and reproductive harm.
The central controversy is not just the health risks but the context of the approval itself. Critics contend that these approvals are part of a broader pattern linked to the massive growth of data centers, suggesting that the rush to develop AI infrastructure has overshadowed the agency’s fundamental duty to protect the public from unreasonable risk.

They contend that because these chemicals may present an unreasonable risk, the Toxic Substances Control Act requires the agency to prohibit or limit the manufacture, processing, and disposal of these substances to ensure public safety. Instead, the agency allegedly approved their use with minimal and non-protective restrictions.
Adding another layer of complexity, these newly approved chemicals appear to be related to PFAS, or “forever chemicals.” These synthetic compounds are known for their incredibly strong bonds, meaning they persist in the environment long after exposure, making them a serious threat to ecosystems and public water systems.
The semiconductor industry has long utilized PFAS in chip manufacturing, and the recent rush to approve new chemicals without establishing rules for their environmental fate is potentially disastrous. This lack of regulation creates a scenario where harmful substances can easily enter the environment without safeguards to prevent their leakage into water systems, such as the Oneida River.
Environmental groups acknowledge that domestic chip production requires these potentially harmful materials, but they insist that regulatory oversight must ensure these chemicals do not contaminate the water and that workers involved in the manufacturing process are protected from exposure.
