The rapid expansion of artificial intelligence has created an insatiable demand for power, driving massive buildouts of hyperscale data centers across the nation. But as the technological revolution accelerates, communities and sovereign nations are fighting to protect their lands from these colossal infrastructure projects. The Cherokee Nation, the largest tribe in the United States, has taken a decisive stand, banning hyperscale data center development on its tribally owned and trust lands after finding a clear conflict between technological growth and community well-being.
This decision followed a comprehensive task force convened by Principal Chief Chuck Hoskin Jr. to examine the potential impact of these facilities on tribal communities. The investigation revealed significant opposition among the public, with 64% of the 1,593 surveyed citizens formally opposing the construction of these massive facilities within the tribe’s 14-county reservation in northeastern Oklahoma. The core concerns cited by the citizens included critical issues such as energy and water consumption, deteriorating air quality, excessive noise, and the protection of vital cultural resources.
In response to these findings, the Cherokee Nation stated clearly: “Our primary responsibility is to protect our citizens and tribal communities from these threats, so we will not support any hyperscale data centers on our reservation without proper consultation,” Hoskin declared.
While the ban protects tribal lands, the scope of the challenge extends beyond the reservation boundaries. The task force explored the wider context of data center development across Oklahoma, noting that while the tribe has no direct regulatory control over non-tribal lands, they possess significant leverage through consultation. Data tracking showed that numerous large projects, such as Google’s Pryor campus and local developments like Project Clydesdale and Project Mustang, operate on non-tribal land, proceeding under municipal and county approvals.
The tribal effort reflects a growing national trend. The Cherokee Nation joined other tribes, including the Seminole Nation and the Kickapoo Tribe, in passing their own moratoriums on similar developments. This push for caution is part of a larger movement that is rapidly multiplying across the U.S., with at least 69 jurisdictions blocking new builds, demonstrating a growing resistance to unchecked infrastructure expansion.
The disconnect between public perception and the reality of AI consumption highlights the urgent need for better understanding. The same survey that recorded significant opposition also found that 73% of respondents use generative AI tools, with a substantial portion using them daily or weekly. This discrepancy suggests that while the public is highly engaged with AI, there is a gap in understanding how the massive energy demands of these systems are fueling the growth.
To bridge this gap and ensure future development is responsible, the task force recommended practical steps. These include developing fact sheets and explainers to educate the public on how everyday AI use feeds hyperscale demand, alongside establishing a permanent advisory committee to evaluate future proposals and advise the Principal Chief as new projects emerge.
